A judge this afternoon denied a motion by the allies of Democratic State Party Chairman John Currie, affirming state Senator Kristin Corrado as a single – not dual – office-holder, and upholding her status as Passaic County clerk only until her scheduled October 5th swearing-in ceremony as senator from the 40th District.

Rajiv Parikh, an attorney with Genova Burns, argued Currie’s case, appealing to the judge for relief of Corrado simultaneously occupying a clerk’s and senate seat. But Passaic County Assignment Judge Ernest Caposela ascertained NJSA 41: 1-1 through NJSA  41: 1-3 as a contravening guidepost, noting that Clerk Corrado is not technically a senator until her swearing-in session.

Corrado slapped at Currie on the other side of the decision.

“Today I spent my entire day in court because in his quest to get a higher taxpayer funded job, John Currie claimed I am a state senator – without ever having been sworn in by the Senate President,” said the senator-elect in LD40. “Our judicial system worked and denied this self serving/financially motivated frivolous lawsuit which was calling upon the judiciary to tell a co-equal branch of government how to run their affairs. I am looking forward to when I am sworn in as Senator of the 40th District, and until then I’m going back to my office to do the job I was twice elected to do as the County Clerk. “
