ELEC Proposes Electronic Filing Amendments

Jeff Brindle, Executive Director of the New Jersey Election Law Enforcement Commission, argues that despite Americans holding a long and deep skepticism toward political parties, ironically it could be the parties that restore stability to our polarized political environment.

The New Jersey Election Law Enforcement Commission (ELEC) is proposing amendments concerning
electronic filing and the statutorily required campaign cost inflation adjustments for Gubernatorial and nonGubernatorial candidates and committees.

Some of the proposed amendments include the following, according to Executive Director Jeff Brindle:
• Implement ELEC’s new electronic filing system;
• Require all reports to be filed electronically;
• Revise language for consistency with electronic filing;
• Streamline and clarify certain administrative procedures involving the Gubernatorial Public
Financing program;
• Implement quadrennial inflation adjustments to limits that apply to gubernatorial candidates and
thresholds that apply to all candidates under the New Jersey Campaign Contributions and
Expenditures Reporting Act (N.J.S.A. 19:44A-1 et seq.);
• Recommend increases to contribution limits for non-Gubernatorial candidates and committees for
legislative consideration;
• Apply an index of 12.84 percent to the various limits and thresholds being modified pursuant to the
statute;
• Adjust the contribution limit for Gubernatorial candidates from $4,300 to $4,900;
• Adjust the maximum penalty for first time violators from $8,600 to $9,800.

The proposed amendments were published in the New Jersey Register on July 20, 2020. They are currently available on the Commission’s website at www.elec.nj.gov/legalresources/reg_proposals.htm.

The Commission will hold a hearing to seek public comment about the proposed amendments on Tuesday, October 20, 2020 at 11:00 a.m. at: Election Law Enforcement Commission (Meeting will be conducted over the internet and is subject to change).

The Commission invites participation in this hearing and requests that any testimony be limited to no more than ten minutes.
