New Jersey State PBA Challenges Governor’s Vaccine Mandate In Courts
The New Jersey State Policemen’s Benevolent Association acting on behalf of twenty-eight (28) of its Local Unions received permission from the Appellate Division of the Superior Court of New Jersey to file an application for a restraining order enjoining Governor Murphy’s Executive Order #283 which mandates that all State and County Correctional Police Officers be vaccinated against COVID-19 and “up to date” with all recommended “booster” doses of either the Pfizer or Moderna vaccine. In addition to the foregoing, the Appellate Division has requested that the State PBA and the State of New Jersey not only brief the issue concerning whether or not a stay should be granted or denied; but also brief the arguments that surround the legalities of the Executive Order.

“We are pleased that we will have the opportunity to fully brief these incredibly important legal issues. When one reads and truly thinks about what’s in this Executive Order, it’s quickly discernable that this matter is not just about the virus and vaccines. There is a lot more to it to include the scope of the Governor’s Executive Power and the question of the State’s ability to intrude into one’s personal medical decision-making abilities. These issues are important to not only these Correctional Police Officers, but all of the citizens of New Jersey.
“In accordance with the Order entered by the Court, the PBA’s moving papers are due no later than 4:00 PM on Friday, January 28, 2022. The State must file its opposition papers no later than 4:00 PM on February 2nd, 2022 and the PBA will have an opportunity to reply to the State’s brief no later than 4:00 PM on February 4th, 2022. Thereafter, the Court will make a decision if it will entertain argument and should it do so, argument will take place on February 7th, 2022 at 2:00 PM.”
