AFP-NJ Celebrates Court Decision to Overturn Home Bakers’ Ban in Wisconsin, Says New Jersey Next

Trenton, NJ – A Lafayette County, Wisconsin judge yesterday overturned the state’s home bakers’ ban, ruling in favor of three women who had challenged the law as unconstitutional. With this decision, New Jersey is now the only state in the entire nation that bans home bakers from selling their cookies, cakes, muffins, and other home-baked treats. The bakers’ ban makes it illegal for private citizens to sell home-baked goods. A bill to repeal these absurd regulations, S-1768, has been introduced in the Senate, but Senator Joseph Vitale, chairman of the Health, Human Services, and Senior Citizens Committee, refuses to post the bill for consideration. Americans for Prosperity-New Jersey (AFP-NJ) has been a vocal advocate of this bill and the rights of entrepreneurs across New Jersey.

“What’s more American than Grandma selling apple pie? Unfortunately, New Jersey is the only state in the country that bans people from selling home-made baked goods to sweet-toothed customers without special government permission,” said AFP-NJ State Director Erica Jedynak. “The Garden State ranks 48 out of 50 states for economic outlook, yet some lawmakers remain eager to force New Jersey entrepreneurs to navigate burdensome regulations in order to succeed. Yesterday was a landmark day in the Wisconsin court system and we look forward to turning up the heat in New Jersey.”
