Holzapfel to Oppose Common Interest Community Legislation

Senator Jim Holzapfel of the 10th Legislative District will be opposing the controversial Common Interest Community Legislation which was pocket vetoed by Governor Murphy in January of this year but has been reintroduced for this session and gaining steam.

The new bill, S-2261, would allow the State to regulate the taxation of common property, the applicability of local ordinances, the effects of eminent domain, and other statutes.

The bill is scheduled for a vote on Monday and Senator Holzapfel will be voting NO. The lawmaker has released the following statement regarding his opposition to this legislation.

“We represent a large senior population that fears this bill will change the way their private communities operate. The state is attempting to regulate something at the local level that is already running smoothly and this legislation could cause confusion for these residents and their local governing bodies.

“Last session, this legislation was pocket-vetoed by the Governor and now the Democrat led legislature has reintroduced it and pushing it through in this session. Our senior residents have voiced their concern over this legislation which seeks to allow the State to change their community’s bylaws. It is up to the residents to decide what they believe is best for their community and over-regulation is not the answer.

“For this reason I will continue voting against this bill in the best interest of our constituents.“
