McCann Paid Out Over $92,000 in Damages Involving Real Estate Deal Steeped in “Irregularities”

Hackensack, NJ — Mayor Steve Lonegan is calling the circumstances surrounding a malpractice lawsuit against his District 5 primary opponent, John McCann, “deeply troubling and disturbing.”

Court documents show that the Congressional candidate lost the lawsuit to divorcee, Gail Lindsley, then of Harrington Park, who accused him of failing to provide adequate representation in relation to a real estate transaction involving her home of 25-plus years and another property in Dumont, NJ.

The 26-count complaint alleged, in part, that John McCann:

  • “[F]ailed to adequately investigate the transaction that occurred at the time of the closing”;
  • “[F]ailed to adequately advise Plaintiff as to the contract on the property and the promissory note that Plaintiff signed”; and
  • “[F]ailed to properly provide for the protection of Plaintiff’s assets within the terms of the sale…”

The case, which originated in 2006 and was adjudicated in 2011, resulted in the Congressional candidate having to pay out over $92,000 in damages as a consequence of his negligence.

“The circumstances of this case are deeply troubling and disturbing. John McCann got his pants sued off because he apparently bungled a simple real estate transaction on behalf of Ms. Lindsley,” asserted Lonegan. “And when she needed his help the most, he told her he couldn’t represent her any longer because he was then representing the man who apparently tried to swindle her – and who had recommended she hire McCann as her attorney in the first place.”

“I don’t know how anyone in the 5th District could trust John McCann to represent them when he failed to represent one innocent woman who simply wanted to sell her home and pay off her mortgage. It’s beyond belief,” said Lonegan.
